Elmo Insurance Ltd is authorised to carry on general business of insurance in Malta in terms of the Insurance Business Act (Chapter 403 of the Laws of Malta) and is regulated by the Malta Financial Services Authority. This website is targeted to residents in Malta and for risks situated in Malta.

Your right to cancel
If you are not entirely satisfied with the protection provided, you have a right to cancel the insurance policy you have purchased within 14 days of the date of issue or receipt of the terms and conditions, whichever is the later provided you would not have lodged a claim under the policy. We will refund you the policy premium you have paid but not the government stamp duty. Notification in writing together with the original Certificate of Motor Insurance must be mailed to Elmo Insurance Ltd, Abate Rigord Street, Ta' Xbiex, XBX 1111, Malta.
If you do not exercise your right to cancel the policy within the 14 day period, you may still cancel the policy at any time by providing us with 7 days’ notice in writing and returning to us your Certificate of Motor Insurance. You should also obtain authorisation from the Licensing and Testing Directorate within the Authority for Transport in Malta. You may be entitled to a refund on short period basis of your premium provided that no claim had been lodged during the current period of insurance.

Our right to cancel
We may cancel the policy by complying with the formalities laid down in the existing legislation. You must deliver the Certificate of Motor Insurance to us as prescribed by Legislation. If the Insurance Certificate is lost or destroyed, you will be requested to provide us with a declaration on oath to this effect. If we cancel the policy, you may be entitled to a refund for any period of insurance which you have not used.

Choice of law & jurisdiction
These terms and conditions shall be governed by Maltese Law. By accessing the site, you have accepted Maltese Law as the law governing the use of the site.
The Courts of Malta shall have exclusive jurisdiction over all claims or disputes arising out of, or in relation to, or in connection with the site and these terms and conditions.
Policy documents detail the law applicable to each contract of insurance.

Language
The language we do business in is English hence, the contents of this website, the terms and conditions of the Motor Insurance Policy and any communication from us will be in the English language.

Complaints procedure
We are committed to provide you with the highest level of service.  However if you are not satisfied with our services, please refer the matter to our Complaints Officer at Elmo Insurance Limited, Abate Rigord Street, Ta' Xbiex, XBX 1111, Malta Tel: +356 2343 0000, Email: complaints@elmoinsurance.com
Your complaint will be acknowledged by our Complaints Officer and a response will be sent to you within a maximum time period of fifteen working days. In the event that your complaint remains unresolved, you may also write to the Office of the Arbiter for Financial Services at First Floor, St Calcedonius Street, Floriana, FRN 5130, Malta.  Freephone: 80072366.  Telephone: 21249245.  You can also download a complaint form from: www.financialarbiter.org.mt.  You may also seek assistance from the Malta Insurance Association with whom this company is affiliated.

Procedure for the submission of claims
If you are involved in an accident you should contact our Motor Claims Department on +356 2343 0000 as soon as possible, to provide us with full details of the accident. One of our Claims Handlers will assist you accordingly
You must also send us immediately any writ of summons, legal document, inquiry or prosecution relating to a claim. You or any person claiming indemnity under the policy must not negotiate, admit or deny liability without our written permission. You must inform the police about cases of theft or other criminal act which may give rise to a claim under the policy.

We shall be entitled to:

  • Take over and conduct in your own name or in the name of anyone else insured by the policy, the defence or settlement of any claim;
  • Institute proceedings at our own expense and for our own benefit, but in your name, or in the name of anyone else insured by the policy, to recover any payment which we have made or may make under the policy;
  • Retain full discretion in the conduct of any proceedings and in the settlement of any claim; and
  • Expect full cooperation regarding any matter affecting the insurance policy from you and anyone else insured by the policy.

Full Disclosure
When you take out, renew or alter any policy, the information you supply to us is the basis on which your cover and premium are agreed. If that information is incorrect or anything changes, please let us know immediately as it could invalidate your policy or result in a claim not being paid. We reserve the right to contact you to enable us to carry out a condition report of your car. Remember you should always inform us about any change immediately. Please do not wait until your renewal.

Protection & Compensation
The Protection and Compensation Fund is made up of contributions by locally licensed insurers and provides limited compensation to policyholders if one of these insurers becomes insolvent. Payments out of the fund are made to qualified persons as defined in the Protection and Compensation Fund Regulations 2003. Collection of information
We collect personally identifiable information, like names, postal addresses, credit card information, email addresses, etc., when voluntarily submitted by our visitors. The information you provide is used to fulfill your specific request. This information is only used to fulfill your specific request, unless you give us permission to use it in another manner, for example to add you to one of our mailing lists. You have the right to request access to, restrict use of, and rectification of, your personal data held by us by directing your request to our office.

Data security
To ensure the security of your credit card information when you purchase insurance cover through Payment gateway website via the Payment Details screen, we use the latest Secure Socket Layer (SSL) technology. SSL is currently the preferred method to securely transfer credit card and other sensitive data over the Internet. If your browser supports SSL, please select the Secure Mode option when confirming your insurance and your credit card and other personal details will be protected by this technology. If you are restricted by the capabilities of your browser then you can use the non-secure mode, but we recommend that you upgrade to the latest version of any browser to allow you peace of mind during any further transactions. At no point is your credit information being stored by our System.
